Q: What happens if my state has workplace safety and health requirements? Which regulations must I comply with?

A:

The OSH Act was written so that any state standard and enforced requirement must be at least as effective as the federal requirements. Therefore, in instances where there are state requirements, employers who are in compliance with state requirements will be in compliance with federal requirements. There are 21 states and 2 territories that have plans covering public and private sector employers. Two additional states have plans that apply just to public sector employers.
